Conditions of Sale

IMPORTANT NOTES

These Rules of Auction comply with Section 45 of the Consumer Protection Act No. 68 of 2008 and the Regulations contained therein applicable to auctions.

  • Only registered bidders may bid. The highest bidder shall be the purchaser.
  • Every bidder must, prior to the commencement of an auction, register their identity in the bidder’s record, providing their identification, juristic registration documents, and proof of residence in terms of the Financial Intelligence Act (FICA), No. 31 of 2001.
  • By registering for an auction, the bidder accepts that they understand and are familiar with the auction bidding process.
  • A purchaser may bid via proxy bid provided the registration requirements are met.
  • The auction house reserves the right to reject any registration at its sole discretion.
  • The auction house reserves the right to exclude any bidder from any online transaction and block any registration of a bidder where the bidder has breached or threatens to breach these terms and conditions, or engages in any behavior which the auction house in its sole discretion regards as likely to have an adverse effect on the conduct of the online transaction or the reputation of the auction house.
  • In terms of section 55(1) of the CPA, goods are sold “voetstoots”, as is, with no guarantees or warranties; express or implied by the auction house. A bid shall be taken as proof that the bidder has inspected the goods and is satisfied with the condition of the goods for which he or she bids
  • Unless specifically specified, all goods are sold with no duty to repair. The auction house and the seller shall not be responsible or required to repair any damaged goods. All bidders must inspect and be satisfied with the condition of all goods sold by the auction house at the auction business site or on the auction site.
  • The auction house has no knowledge of the condition or state of the goods which accedes the above and accordingly shall not be held liable in any way for the condition or state of any goods of which the auction house is unaware or cannot reasonably have knowledge of including any errors in the description of any of the goods.
  • Our catalogue is for reference purpose only and is subject to change without prior notice. Cape Auctioneers cannot be held responsible for any errors of description in the catalogue or media. Information and description given verbally or advertised in the media are given in good faith.
  • Neither the seller nor Cape Auctioneers shall be held liable for errors herein nor any representation or statement made by the Auctioneer on information given in respect of the items on auction.
  • The Auctioneer reserves the right to regulate the bidding and to alter, combine or withdraw any lot or vary order of same.
  • The Auctioneer’s decision is final, and no dispute will be taken into consideration. The Auctioneer is entitled to correct an error in the conclusion of any sale.
  • Certain goods may carry a reserve price. The auctioneer reserves the right to bid on these goods on behalf of the seller, up to the reserve price.
  • 18% Buyers Commission, will be added to your account. For example, a R1000 final bid will attract R180 in commission, making a total of R1180.
  • All goods must be paid in full within 24 hours and funds must reflect in our bank account before we release your purchases.
  • NO CASH will be accepted at the auction site due to security reasons. Payment can be made in the following methods:                                       (a) immediate electronic transfer (b) credit/debit card (extra 3% charge) “no American Express or Diners card can be excepted” (c) cash deposit (extra 3% charge)
  • Failing settlement of your purchases, the auctioneer/seller reserves the right to obtain relief for the amount paid, interest, legal and collection costs. 
  • No collection of goods will be allowed while the Auction is in progress.
  • Collections: Immediately after the auction, Saturday between 12:00 and 16:00 or on Monday after the auction between 10:00 to 17:30. A storage fee of R50 per lot per day will be charged for every day there after.
  • All goods paid for but not collected within 10 working days from the Auction date will be illegible to be resold to recover costs and the buyer will be held responsible for all losses incurred.
  • The Purchaser will be responsible for the removal of their goods and for any damages to the building or other items while removing the goods.
  • All packaging and handling of goods is at the buyers own risk.
  • Courier, packaging and transport cost is the responsibility of the buyer. Our friendly staff will assist in preparing items for courier collections.
  • All persons including bidders, their heirs, executors, administrators or assigns shall not hold the auction house, the auctioneer, their agents and/or employees liable for any injuries, damages or any losses of any nature whatsoever arising from any person’s attendance and/or participation in the auction and releases the auction house, the auctioneer, their agents and/or employees and hold them harmless from any duty of care towards them and all claims which may otherwise have accrued to them whether or not any such claim may arise through the negligence of any person or from any of the risks, dangers or hazards occurring in the course of their association with the auction house, auctioneers and the sellers.
  • Sellers are welcome to contact us relating to items to be sold on our auction
